New OECD research based on surveys of 30,000+ workers and 6,000 companies across 15 countries reveals that non-compete clauses now cover one-fifth to one-third of private-sector workers — far beyond their original purpose of protecting trade secrets. These clauses increasingly apply to low-wage, low-skill workers with no access to confidential information, are often uncompensated, and frequently exceed what courts would enforce. Despite being legally questionable, they suppress job mobility through a chilling effect: workers avoid moving simply because they believe the clause might be enforced. The data links higher non-compete prevalence to lower job mobility, slower wage growth, and reduced productivity (a 10 percentage-point increase in coverage correlates with a 1.9% productivity decline). Policy responses range from outright bans to targeted regulations on duration, compensation, and disclosure, but enforcement and transparency remain weak across most OECD countries.
